Classes of Work Permits in Kenya

Any foreigner who wishes to work or reside in Kenya whether voluntarily or paid must have a work permit for them to be legally accepted by the Kenyan government. The residence or work permit is issued by the Department of Immigration Services. It is under the Citizenship and Immigration Act 2011, sections 36, 40,41, and 42, of the Laws of Kenya that all visas and work permits are issued. There are different classes of permits and it is for this reason that Dennykins associates -KRA Tax Agent prepares this article to enhance comprehension of the various categories/classes of work permits in Kenya. 

Work Permits and Passes

The fundamental role of the Permits Section is processing and issuance of passes and work permits. Each permit has its precise requirements that individuals must have for them to be granted permit. There are different classes of permits as provided under the permit’s regulations. 

Application and Collection of Submissions

Every application for passes and permits are submitted online with all the required attachments. The general requirements for the various categories include application Form 3 that are dully filled and signed, copies of the national passport, a covering letter from the employer and colored passport photos-two. However, it is important to note that the cover letter varies depending on the class of permit one needs. Nevertheless, every class requires a covering letter. 

Various Classes of Permits in Kenya

  ü  Class A: Prospecting And Mining

  ü  Class B: Agriculture And Animal Husbandry

  ü  Class C: Prescribed Profession

  ü  Class D: Employment

  ü  Class F: Specific Manufacturing

  ü  Class G: Specific Trade, Consultancy or Business

  ü  Class I: Approved Religious or Charitable Activities

  ü  Class K: Ordinary Residents

  ü  Class M: Refugees

  ü  Students’s Pass

  ü  Kenya Special Pass

  ü  Dependant’s Pass

  ü  Research/Internship Pass

The following are the requirements to apply for the various classes of permits in Kenya:

  Class A: Prospecting and Mining

  • Current immigration status if in the country
  • Signed audited accounts for the last one year-for renewal
  • A copy of national passport
  • Form 25 dully filled and signed
  • Signed cover letter from self/employer/organization addressed to the Director General of Immigration Services
  • Current license and copy of PIN certificate- for renewals
  • Proof of investment funds f at least USD 100,000
  • Valid entity Tax Compliance Certificate for new cases, and individual Tax Compliance Certificates for renewal cases
  • Two recent colored passport photos
  • Processing fee of Kshs. 10,000 which is non-refundable
  • Issuance fee of Kshs. 100,000 annually
  • Gratis – East Africa Community Member States

  Class B: Agriculture and Animal Husbandry

  • Copy of PIN certificate
  • Proof of land ownership or leasehold
  • Current audited accounts-for renewal
  • Proof of capital availability-bank statement of at least USD 100,000
  • Two recent passport photos
  • Form 25 dully filled and signed
  • A copy of national password
  • Current immigration status when already in the country
  • Valid individual tax compliance certificate, plus valid entity tax compliance certificate
  • Signed cover letter from self/employer/entity addresses to the director general of immigration services
  • Processing fee of Kshs. 10,000 which is non-refundable
  • Issuance fee of Kshs. 100,000 annually
  • Gratis – East Africa Community Member States

  Class C: Prescribed Profession

  • Copy of PIN certificate
  • A copy of national passport
  • Proof of membership to the prescribed profession
  • Current immigration status if in the country
  • A copy of national passport
  • Form 25 dully filled and signed
  • Signed cover letter from self/employer/organization addressed to the Director General of Immigration Services
  • Valid entity Tax Compliance Certificate for new cases, and individual Tax
  • Compliance Certificates for renewal cases
  • Two recent colored passport photos
  • Copies of certified academic and professional qualifications
  • Processing fee of Kshs. 10,000 which is non-refundable
  • Issuance fee of Kshs. 100,000 annually
  • Gratis – East Africa Community Member States

  Class D: Employment

  • Clearance letter from relevant institutions
  • Certificate of registration of the entity
  • Resume of the understudy
  • Form 27 dully filed and signed
  • Certified copies of all academic certificates and full contacts of the understudy- email, cell phone, address
  • Duly certified copies of professional and academic certificates
  • Curriculum vitae
  • Properly filed and signed application form 25
  • A copy of national passport
  • A copy of national passport
  • Signed cover letter from self/employer/organization addressed to the Director General of Immigration Services
  • Valid entity Tax Compliance Certificate for new cases, and individual Tax
  • Two recent colored passport photos
  • Processing fee of Kshs. 10,000 which is non-refundable
  • Issuance fee of Kshs. 200,000 annually
  • Gratis – East Africa Community Member States

  Class F: Specific Manufacturing

  • Copy of PIN certificate
  • CR12- shareholders certificate
  • Dully signed articles of association
  • Memorandum of association
  • Form 25 duly filed and signed
  • Copy of held license
  • The company’s registration certificate
  • Proof of funds available for investment in manufacturing of at least USD 100,000
  • Processing fee of Kshs. 10,000 which is non-refundable
  • Issuance fee of Kshs. 100,000 annually
  • Gratis – East Africa Community Member States
  • Individual tax compliance certificate, plus company tax compliance certificate for new cases
  • Current immigration status if already in the country
  • Copy of national ID
  • Signed cover letter from self/employer/organization addressed to the Director General of Immigration Services

  Class G: Specific Trade, Consultancy or Business

  • Form 25 duly filed and signed
  • Form 27 duly filled
  • Current audited accounts duly signed-for renewal
  • Certificate of incorporation of the entity
  • Articles of association
  • Copy of PIN certificate
  • Documents proving availability of capital to be invested of at least USD 100,000
  • Copy of national passport
  • Two recent and colored passport photos
  • Current immigration status if in the country
  • Valid organization and individual tax compliance certificate
  • Signed cover letter from self/employer/organization addressed to the Director General of Immigration Services
  • Processing fees of kshs. 10,000 which is non-refundable
  • Annual issuance fees of kshs. 100,000
  • Gratis – East Africa Community Member States

  Class I: Approved Religious or Charitable Activities

           This is issued to the following group of people:

  1. Members of trustee registered under a trustee act
  2. Members of Co limited by grantee
  3. Members under societies act
  • Certified copies of academic and professional certificates
  • Form 25 duly signed
  • Registration certificate of the entity
  • Copy of national passport
  • Two recent and colored passport photos
  • Current immigration status if in the country
  • Valid organization and individual tax compliance certificate
  • Signed cover letter from self/employer/organization addressed to the Director General of Immigration Services
  • Processing fees of Kshs 1,00 non-refundable
  • Issuance fee of kshs 5,000 yearly
  • Gratis – East Africa Community Member States
